A New York state senator wrote a letter to the state’s Workplace of Hashish Administration, urging management to interact in “aggressive motion” on unlicensed hashish retailers after witnessing them in his personal neighborhood.

State Senator Brad Hoylman-Sigal, chair of the Senate Judiciary Committee, and representing New York’s forty seventh State Senate District on Manhattan’s West Facet, is bored with unlicensed hashish shops and dispensaries popping up throughout city.

Hoylman-Sigal wrote a public letter on July 17, addressed to Workplace of Hashish Administration Government Director Christopher Alexander and Tremaine Wright, chair of the Hashish Management Board, urging motion instantly.

“Within the 2023 funds, the New York State Legislature granted extra authority to the Workplace of Hashish Administration (OCM) and the Division of Taxation and Finance (DTF) to deal with unlicensed hashish shops,” Hoylman-Sigal wrote. “This contains conducting inspections, imposing civil penalties, and looking for injunctions to close down shops. I’m grateful to see OCM and DTF start to take motion. Given the intense points brought on by these shops, I urge OCM and DTF to proceed to behave rapidly and aggressively to close down these unlicensed shops.”

Hoylman-Sigal addressed the severity of the problem, together with shops dotting Manhattan.

“The size of those unlicensed shops is staggering, with over 100 shops recognized in Hell’s Kitchen alone. As I’ve expressed previously, these shops are misleading to shoppers, hazardous to public well being, dishonest on their taxes, undermining the State’s equity-based and authorized hashish rollout, and have little incentive to examine IDs to make sure they aren’t promoting to minors. Moreover, as a result of these shops are unregulated and have little oversight, they pose a hazard to staff and neighbors.”

Hoylman-Sigal went a step additional to call dispensaries which are both unlicensed or have obtained complaints.

“I’m enclosing an inventory of shops which have been reported to us by constituents in addition to an inventory of unlicensed shops in Hell’s Kitchen compiled by the Hell’s Kitchen Neighborhood Coalition. I urge OCM to behave expeditiously to close down these shops.”

New York Takes Motion on the Proliferation of Unlicensed Hashish Retailers

New York Gov. Kathy Hochul can also be ramping up efforts to deal with the unlawful dispensary state of affairs.

New York State Workplace of Hashish Administration and Division of Taxation and Finance started inspections of unlicensed outlets in early June below a brand new regulation signed by Gov. Hochul a month prior in Could.

The new law signed by the Governor in Could is a part of the State’s Fiscal 12 months 2024 Funds. The beefed up penalties embrace fines of as much as $20,000 per day, used to discourage criminality.

“Beneath new powers that I fought for on this 12 months’s State funds, we will now conduct enforcement towards companies illegally promoting hashish, and I’m proud to report that in simply the primary three weeks of our efforts, we’ve seized almost $11 million price of illicit merchandise off the streets,” Governor Hochul stated. “These unlicensed companies violate our legal guidelines, put public well being in danger, and undermine the authorized hashish market, and with the highly effective new instruments in our toolbelt we’re sending a transparent and powerful message: in case you promote unlawful hashish in New York, you may be caught and you may be stopped.”

The New York Metropolis Council can also be stepping in. At a gathering of the New York Metropolis Council final January, officials pledged increased enforcement against unlicensed cannabis retailers and stated that the state legislature is drafting new laws to provide regulation enforcement extra powers to close down illicit pot outlets. In the meanwhile, unlicensed shops are straightforward to seek out within the state.
